TfP (Time for Print)
The models "right of his picture" and the
photographers "copyright" are in conflict, means both the model
and the photographer can't use the taken pictures without harming the
others right.
To resolve this unclear
situation professional model and photographers are signing a
so called "TfP Model
Release", allowing the model to get the best photos of
the photo shooting for personal use. The photographer gets the
right to use and publish the taken pictures. Please find the "TfP
Model Release" I use below:
Model shall receive a copy of
the best pictures taken during the photo shooting. Photographer agrees to provide a
copy of 10-20 pictures on CD-Rom for free. Model shall have the right to display
the provided pictures in any media form, use or print images for the models portfolio or website.
If model uses or publishes via print or electronic media any of the images taken by the photographer, model agrees to include photographer name credit within the image if digital media, or photo credit within the document if by print media.
For
good and valuable consideration, the receipt and sufficiency of which
are hereby acknowledged, I (the model) hereby irrevocably and perpetually grant to
"BearPhotographer"
or his assignees (“Photographer/Web Site Owner”) the unrestricted
right and authority to use, display or sell any and all photographs
and images for digital transmission through the Internet and/or any
form of communication including but not limited to, web sites, digital,
video, photographic print medium or advertising available now &
future.
I (the
model) acknowledge and agree that the Web Site Owner may use and
exploit the Content in any manner, without restriction.
I
(the model) hereby
waive any right that I may have to inspect or approve the finished
work(s) or the use to which it may be applied. I agree that the images
and or recordings taken of me, and any resulting reproductions shall
constitute "BearPhotographer" sole property, to copyright in
his own name or his company name and with full right of disposition in
any manner whatsoever.
I (the
model) hereby release and hold the photographer & Web Site Owner
harmless from and against all claims, suits, threats, demands,
liabilities, from me, or my heirs for use of these images.
I (the model)
represent & warrant to you that I am over the age of majority (18)
in the state in which this Release is executed & I
hereby agree to the terms of this release. Otherwise, my legal
guardian must agree and sign this release.
I
have read the above authorization and release, prior to its execution,
and I am fully familiar with the contents thereof.
This release shall be binding upon me, my heirs, legal
representatives and assigns.
TFP: (Time For Print) means, model shall receive a copy of
the 10-20 best images taken during the photo shooting on CD-Rom for
free.
